Terms of Use

These Terms of Use ("Terms") are the agreement between you and Proportione, LDA ("we", "us") for the BirdRisk app and website. By downloading, accessing or using BirdRisk you agree to these Terms. If you do not agree, do not use BirdRisk.

Safety — read this first

BirdRisk shows bird-strike risk information only. It is NOT a navigation, air-traffic, weather, terrain or flight-safety system, and it does not provide flight advice. BirdRisk informs, it does not advise: it never tells you whether to fly, when to depart, which route or altitude to choose, or whether any flight is safe. You, the pilot in command, remain solely responsible for every flight decision, for complying with all applicable aviation regulations, and for using official sources (NOTAMs, ATC, AIS, weather services). Never use BirdRisk as a sole or primary source for any flight-safety decision.

01Eligibility and account

You must be able to form a binding contract to use BirdRisk. Some features require an account; you are responsible for keeping your credentials secure and for activity under your account. Provide accurate information and keep it up to date.

02Licence

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use BirdRisk for your own lawful, non-commercial flight planning and situational awareness, subject to these Terms and to Apple's Standard EULA, which also applies. You may not copy, modify, reverse-engineer, resell, sublicense or create derivative works from BirdRisk, nor use it to build a competing product or to scrape or redistribute its data.

03Subscriptions and billing

BirdRisk offers an auto-renewable subscription sold through the Apple App Store. Key terms:

Payment is charged to your Apple Account at confirmation of purchase.
The subscription renews automatically for the same period and price unless you cancel at least 24 hours before the current period ends.
You manage or cancel your subscription in your Apple Account settings; we cannot cancel it for you.
Any free trial unused portion is forfeited when you buy a subscription.
Prices may change; we will give notice and any change applies only to future renewals.

Refunds for App Store purchases are handled by Apple under their terms.

04Data accuracy and "as is"

BirdRisk's risk information is derived from open and third-party data sources and statistical modelling. It may be incomplete, delayed, or wrong, and bird movements are inherently unpredictable. We provide BirdRisk "as is" and "as available", without warranties of any kind — express or implied — including accuracy, completeness, fitness for a particular purpose, or availability. We do not warrant that BirdRisk will be uninterrupted or error-free.

05Acceptable use

You agree not to misuse BirdRisk: no unlawful use, no interference with its operation or security, no automated extraction of its data, and no use that could endanger any person or aircraft. We may suspend or terminate access for breach of these Terms.

06Intellectual property

BirdRisk, its name, design, software and content are owned by Proportione, LDA or its licensors and are protected by law. These Terms grant you no rights in them beyond the licence above.

07Limitation of liability

To the fullest extent permitted by law, Proportione, LDA is not liable for any indirect, incidental, special or consequential damages, nor for any loss arising from your reliance on BirdRisk's information or from any flight decision. Nothing in these Terms excludes liability that cannot be excluded under applicable law (including for death or personal injury caused by our negligence). Where liability cannot be excluded, it is limited to the amount you paid us for BirdRisk in the 12 months before the claim.

08Privacy

Our handling of your data is described in our Privacy Policy, which forms part of these Terms.

09Changes and termination

We may update these Terms from time to time; material changes will be posted on this page with a new "last updated" date, and continued use means you accept them. We may modify, suspend or discontinue BirdRisk, in whole or in part, at any time. You may stop using BirdRisk at any time.

10Governing law

These Terms are governed by the laws of Portugal, without regard to conflict-of-law rules, and the courts of Aveiro, Portugal have jurisdiction, subject to any mandatory consumer-protection rights you have in your country of residence.
